Spouse Visa

This allows a spouse/civil partner of a UK citizen, person settled in the UK or having a refugee status / humanitarian protection in the UK, to apply & enter the UK.

Outside of the general requirements, there are certain conditions that must be met by the applicant for this category:

  • Relationship requirements – Needs to be a genuine and ongoing relationship
  • Minimum income level – £18,600.00
  • Maintenance funds
  • Sufficient grasp of the English language

Typically, this visa must be obtained by the applicant before entering the UK. Under certain conditions, one can can switch to this visa if they are already in the UK under a different visa.

PBS Dependents – Tiers 1,2, 4 or 5 (Points Based System)

This visa category is for non-EEA nationals wishing to join their family members in the UK who hold a valid Tier 1 (Highly Skilled), Tier 2 (Skilled Workers), Tier 4 (Students) or Tier 5 (Temporary Workers) visa. These 4 tiers fall under the points-based system.

Under this category, the dependant is allowed to live in the UK as long as the main applicant’s visa is valid. If the main applicant is granted indefinite leave to remain as a PBS Migrant, then the PBS dependant may qualify for indefinite leave to remain.

Apart from general visa requirements, there are certain conditions that must be met by the applicant for this visa category; such as:

  • Relationship requirements (dependant must be either a husband, wife, civil partner, unmarried or same-sex partner or child aged under 18)
  • Documentary evidence establishing dependency
  • Maintenance funds
  • Sufficient knowledge of the English language

This type of visa can be obtained by the applicant before coming into the UK or as an extension after entering the UK.

Indefinite Leave to Remain (ILR)

Spouses or partners of British citizens, persons settled in the UK or persons having refugee status or humanitarian protection in the UK, can apply for a visa to remain with their loved ones indefinitely through this visa category.

Apart from general visa requirements, there are certain conditions that must be met by the applicant for this visa category; such as:

  • Relationship requirements – Must be a genuine and subsisting relationship
  • Maintenance funds
  • Suitability requirements
  • Sufficient knowledge of the English language
  • Sufficient knowledge of life in the UK

The applicant can only be eligible to apply for their ILR in the UK once they have completed the residential qualifying period in the UK.

ILR to Remain as Parent of a Child:

Parents of children who are British citizens or are settled in the UK can apply for a visa to remain in the UK indefinitely through this visa category if they have sole parental responsibility and it is in the children’s best interest for the parent to be granted indefinite leave to remain in the UK.

ILR – 10 Years Residence

This visa category allows people to apply for ILR on the basis of 10 years of their continuous and lawful residence in the UK.

There are certain conditions that must be met by the applicant for this visa category; such as:

  • Documentary evidence of “continuous and lawful residence” for 10 years

  • Sufficient knowledge of the English language
